These Terms and Conditions (“Terms”) govern your access to and use of Crytonix websites, software, APIs, dashboards, automation tools, messaging features, applications, and related services (collectively, the “Services”).

In these Terms, “Crytonix,” “we,” “our,” or “us” means Crytonix. “You” and “your” mean the individual or entity accessing or using the Services.

By accessing, creating an account for, purchasing, or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

Subject to your compliance with these Terms, Crytonix grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your internal business or personal use, as applicable to your plan and purchased features.

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Services except as expressly permitted by us
• Reverse engineer, decompile, disassemble, or attempt to derive source code except where prohibited by law
• Circumvent usage limits, access controls, plan restrictions, billing controls, or technical safeguards
• Use the Services in a way that interferes with, damages, or disrupts the platform or other users
• Use the Services for unlawful, fraudulent, abusive, deceptive, or infringing activity

Certain features may be modified, suspended, or discontinued at any time, with or without notice, unless otherwise required by law or explicitly provided in a separate written agreement.

You agree not to use Crytonix to engage in unlawful, harmful, abusive, fraudulent, or unauthorized conduct. This includes, but is not limited to:

• Violating any law, regulation, court order, or third-party right
• Attempting to gain unauthorized access to accounts, systems, devices, or data
• Distributing malware, harmful code, spam, or malicious automation
• Using the Services to harass, impersonate, deceive, exploit, or abuse others
• Uploading, processing, or transmitting data you do not have the legal right to use
• Interfering with platform security, integrity, uptime, or performance
• Using the Services in a manner that could create legal or compliance risk for Crytonix

We may investigate suspected misuse and take action including restriction, suspension, account removal, or cooperation with law enforcement where appropriate.

Crytonix may provide SMS-based messaging related to account security, authentication, verification, and service operations. By opting in, enabling SMS features, or providing your phone number for supported features, you consent to receive SMS messages from Crytonix subject to these Terms.

Crytonix and its licensors retain all right, title, and interest in and to the Services, including all software, interfaces, designs, workflows, branding, trademarks, logos, documentation, graphics, text, and other platform materials, except for User Content.

No rights are granted to you except the limited rights expressly stated in these Terms.

Crytonix may integrate with, rely on, or link to third-party products, services, payment processors, hosting providers, API providers, cloud vendors, messaging vendors, and other external platforms.

Third-party services are governed by their own terms, policies, and practices. Crytonix is not responsible for the availability, performance, or conduct of third-party services.

You may stop using the Services at any time. Crytonix may suspend, limit, or terminate your access at any time, with or without notice, if:

• You violate these Terms
• Your use creates legal, security, abuse, fraud, or operational risk
• Payment is overdue or disputed
• We are required to do so by law or third-party provider obligations
• We discontinue the relevant Service or feature

On termination, your right to access the Services ends immediately, but provisions that by their nature should survive termination will survive, including payment obligations, intellectual property terms, disclaimers, liability limitations, indemnification, and dispute-related provisions.

To the maximum extent permitted by law, Crytonix disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, uninterrupted access, and error-free operation.

We do not warrant that the Services will meet your requirements, be secure from every possible threat, operate without downtime, or be compatible with every device, carrier, integration, or third-party environment.

To the maximum extent permitted by law, Crytonix and its affiliates, officers, employees, contractors, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, use, or other intangible losses, arising out of or related to the Services or these Terms.

To the maximum extent permitted by law, the aggregate liability of Crytonix for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:

• The amount you paid to Crytonix for the applicable Services during the three (3) months before the event giving rise to the claim, or
• $100 USD

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you to the extent prohibited by law.

You agree to defend, indemnify, and hold harmless Crytonix and its affiliates, officers, employees, contractors, licensors, and suppliers from and against claims, liabilities, damages, losses, judgments, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the Services
• Your User Content or data
• Your violation of these Terms
• Your violation of applicable law or third-party rights
• Your misuse of credentials, messaging features, integrations, or automation workflows

These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction in which Crytonix operates, without regard to conflict of law principles, except where otherwise required by applicable law.

You may want to replace this section with your preferred state, venue, arbitration clause, or dispute resolution language if you want it customized for your business structure.

Crytonix may update these Terms from time to time. When we do, we may revise the Last Updated date shown on this page.

Continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by law.
